We, PeopleSmart SAS, might use personal data to provide our services such as training, facilitation, design & development, assessment, coaching and consulting. Below we have described how we collect, store and use personal data as well as the steps our consultants and clients can take to control what we do with these data.

When we talk about data and personal data in this Privacy Policy, we mean personal data which identify an individual or which could be used to identify an individual such as names and contact details.

3. How we use your data

We will only use your personal data if we have a proper and legitimate reason for doing so. In general, you can visit the PeopleSmart website without telling us who you are and without revealing any information about yourself. However there may be occasions when you choose to give us personal information either to obtain more information about us or as part of our consulting services such as recruitment, training or others. If this is the case we will:

  • Only use your personal data if we have a proper reason for doing so and

  • Only use your personal data if we have a legal duty to do so and/or
  • When it is in our legitimate interests.

Legitimate interests are our business or commercial reasons for using personal data, but even so, we will not unfairly put our legitimate interests above what is best for you.

4. How long we keep your data

We keep your data only with your consent and only for as long as we need it. How long we need data depends on what we are using it for whether that is to provide services to you, for our own legitimate interests or so that we can comply with the law.

We will review the information we hold and when there is no longer a service, legal or business need for us to hold it, we will delete it securely.

5. How we protect your data

We do our utmost to protect your personal data against unauthorised access, unlawful use, accidental loss, corruption or destruction.

We use technical measures such as encryption and password protection to protect your data and the systems they are held in. We also use operational measures to protect the data, for example by limiting the number of people who have access to the databases in which our intellectual property (emails, documents and materials) is held.

We might share some of your personal data with the following categories of third parties: 1) existing or new client organisations; 2) PeopleSmart consultants who might work with you; 3) other members of PeopleSmart’s operational business organisation; 4) our accounting firm and 5) tax authorities (in the scope of our legal obligations).

7. Sending data outside the European Economic Area (EEA)

We will only send data outside of the European Economic Area (“EEA”) to work with our consultants, clients and suppliers who are based outside the EEA and who have a legitimate reason to obtain information about you.

If we do transfer data outside the EEA, we will make sure that it is protected in the same way as if it were being used in the EEA.

8. Your rights

You are entitled to see copies of all personal data held by us and to amend, correct or delete such data. You can also limit, restrict or object to the processing of your data.

If you gave us your consent to use your data, you can withdraw your consent. Please note that even if you withdraw your consent, we can still rely on the consent you gave as the lawful basis for processing your data before you withdrew your consent.
